Which version governs
A blank for the governing language, why it was chosen, and a statement that another version is read to agree with it.
Preparing, checking and adopting translations
Who prepares them and at whose cost, the translator's qualification, a review period, a process if the parties disagree and adoption by signing or initialling.
Certification and terms that do not translate
Whether and by whom a version is certified and for what purpose, and a list of terms with their agreed meaning in every version.
Names, figures, dates and later changes
How names, numbers and dates are written, which version is used for what, notices in other languages, amendments made first in the governing language and a register of versions.
About this document
A governing language and translation agreement is for a contract that will exist in more than one language. It identifies the document, the languages and which was negotiated first, says which version governs and why, who prepares the others, how translations are checked and adopted, whether a version is certified, how terms that do not translate are handled, how names, figures and dates are written, and which version is used for what.
This blank form is completed by hand and signed by both parties and a translator. It records the parties' choice of governing language and says a court or authority in a particular country may apply its own approach whatever the agreement says. What a country requires for translation, certification or recognition of a document differs, so check with advisers in the places where the document will be used.
